1. Agreement to Terms

By accessing or using the Win My Work platform ("Platform"), available at winmywork.com, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms apply to all users of the Platform, including homeowners, contractors, and visitors.

2. Description of Service

Win My Work is a home services marketplace that connects homeowners with verified local contractors. The Platform enables homeowners to describe their home improvement projects, receive competitive quotes from contractors, and select the professional best suited for their needs. Services currently available through the Platform include, but are not limited to, fencing, decking, roofing, HVAC, flooring, painting, plumbing, electrical, landscaping, and general handyperson services.

3. User Accounts

To use certain features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and accept all risks of unauthorized access
• Notify us immediately of any unauthorized use of your account
• Not create more than one account per person

We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent activity.

4. Homeowner Terms

As a homeowner using the Platform, you acknowledge and agree that:

• You may submit project details including descriptions, photos, property measurements, and budget ranges to receive quotes from contractors
• Submitting a project and receiving quotes is free of charge
• When you accept a contractor's bid, the contractor pays a 2% platform fee to unlock your contact details and communicate directly with you
• Win My Work does not guarantee the quality, timing, or completion of any work performed by contractors
• You are responsible for verifying contractor credentials, licenses, and insurance independently
• All agreements for work are between you and the contractor directly

5. Contractor Terms

As a contractor using the Platform, you acknowledge and agree that:

• You must provide accurate business information including licensing, insurance, and service area details
• You are subject to a verification process before your profile becomes active on the Platform
• Quotes submitted through the Platform are binding offers unless otherwise specified
• You will perform all work in accordance with applicable local, state, and federal laws and regulations
• You are an independent contractor and not an employee, agent, or representative of Win My Work
• You maintain your own liability insurance and worker's compensation as required by law

6. Fees and Payments

Win My Work charges a platform fee to facilitate connections between homeowners and contractors:

• Platform Fee: A 2% fee based on the contractor's quoted amount, payable by the contractor to unlock homeowner contact information after their bid is accepted
• Contractor Subscription: Contractors pay a recurring monthly subscription to access leads, priced according to the counties and services they select. New contractors receive a free trial period before billing begins. Subscription pricing is displayed before purchase, and contractors may change their coverage or cancel at any time
• Payment Processing: All payments are processed securely through Stripe, our third-party payment processor
• No Hidden Fees: Beyond the contractor subscription and the 2% platform fee described above, there are no signup fees or per-lead charges. The Platform is free to use for homeowners
• Contractor Payments: All payments for actual work performed are made directly between the homeowner and contractor, outside of the Platform

7. Platform Role and Limitations

Win My Work serves solely as a marketplace connecting homeowners with contractors. We do not employ contractors, supervise their work, or guarantee outcomes. We do not provide construction, repair, or any home improvement services directly. The Platform uses technology including mapping tools, satellite imagery, and measurement tools to assist users in describing their projects, but these tools are provided for estimation purposes only and should not be relied upon as professional measurements or assessments.

8. Intellectual Property

All content, features, and functionality of the Platform, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of Win My Work and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content on the Platform without our prior written consent.

9. User Content

By uploading photos, descriptions, reviews, or other content to the Platform, you grant Win My Work a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with operating and promoting the Platform. You represent that you own or have the right to share all content you upload and that it does not violate any third-party rights.

10. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws
• Submit false, misleading, or fraudulent project descriptions, quotes, or reviews
• Harass, threaten, or abuse other users of the Platform
• Circumvent the Platform to avoid paying applicable fees
• Scrape, data mine, or use automated tools to extract data from the Platform
• Interfere with or disrupt the Platform's infrastructure or other users' experience
• Impersonate any person or entity, or falsely state or misrepresent your affiliation

11. Dispute Resolution

Any disputes arising between homeowners and contractors regarding the quality, completion, or terms of work performed should be resolved directly between the parties involved. Win My Work is not a party to any agreement between homeowners and contractors and bears no responsibility for resolving such disputes. For disputes related to the Platform or these Terms, you agree to first attempt to resolve them through our support team before pursuing formal action.

12. Limitation of Liability

To the maximum extent permitted by law, Win My Work shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Platform. Our total liability for any claim arising out of or relating to these Terms shall not exceed the total amount of fees paid by you to Win My Work in the twelve months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Win My Work, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Platform, your violation of these Terms, or your violation of any rights of another person or entity.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Platform. Your continued use of the Platform after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.

15. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located within the jurisdiction of our principal place of business.
